General Terms and Conditions and Customer Information

I. General Terms and Conditions
§ 1 Scope
(1) These General Terms and Conditions apply to all contracts that you conclude with us, Roman Lukiyanov, SilberKosmos – Premium Geschenkideen, Faleska-Meinig-Str. 126, 09122 Chemnitz (hereinafter “we”), via the online shop https://premiumgeschenk.de. We object to any deviating terms of the customer unless otherwise agreed.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). A trader is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession (§ 14 BGB).
§ 2 Conclusion of contract
(1) The subject matter of the contract is the sale of goods, with an individual engraving on request.
(2) By presenting a product in our online shop, we make you a binding offer on the terms stated in the product description.
(3) The contract is concluded via the shopping cart system as follows: you place the desired goods in the shopping cart, which you can view and change at any time. Via the “Checkout” button you enter your contact, delivery and payment details. If you choose a payment method with redirection (e.g. PayPal or Klarna), you are redirected to the respective provider and then returned to the shop. Before submitting the order, you see an overview of your order and can check and correct all details or cancel the order. By clicking the “Pay now” or “Order with obligation to pay” button (or a button with equivalent wording), you bindingly accept our offer; the contract is thereby concluded.
(4) Immediately after placing the order, you will receive an order confirmation by e-mail. Please make sure that your e-mail address is correct and that our e-mails are not held back by a spam filter.
(5) If you request an individual offer (e.g. custom-made item, express shipping), your request is non-binding. We will send you a binding offer in text form (e.g. by e-mail), which you can accept within 5 days, unless a different period is stated in the offer.
§ 3 Engraving and individually designed goods
(1) For an engraving, you provide us with the desired text when ordering or by e-mail without undue delay afterwards. Where necessary, we agree the wording and placement with you before carrying out the engraving.
(2) Whether and where an item can be engraved is stated in the respective product description. Where an engraving is only possible after inspection, we inspect the item before carrying out the engraving. If an engraving cannot be carried out, we will inform you and refund the price of the engraving.
(3) You are responsible for the content of the engraving text and warrant that it does not infringe any third-party rights (e.g. trade mark rights, name rights or copyrights) and does not violate any laws. We do not check the text for correctness of content; spelling errors in your template are not our responsibility.
(4) Goods with an individual engraving are excluded from the right of withdrawal (§ 312g Abs. 2 Nr. 1 BGB); see our Withdrawal Policy.
§ 4 Prices and shipping costs
(1) All prices are final prices in euros including statutory VAT.
(2) Any additional shipping costs are shown in the product offer, on the Payment and Shipping page and during the ordering process. We deliver free of shipping costs within Germany.
(3) For deliveries to countries outside the European Union, customs duties, import taxes and fees of the parcel service may be incurred in the recipient country. These are not charged by us and are to be borne by you.
§ 5 Payment
(1) The payment methods available to you are shown on the Payment and Shipping page and during the ordering process. We currently offer: credit card, Shop Pay, Apple Pay, Google Pay, PayPal, Klarna, further local payment methods depending on the country, prepayment by bank transfer and PayPal.Me (manual payment).
(2) Payments by credit card, Shop Pay, Apple Pay, Google Pay and the country-specific payment methods are processed via Shopify Payments. The amount is charged when the order is completed.
(3) Payments with PayPal are processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxemburg. PayPal’s terms of use apply.
(4) Payments with Klarna are processed via Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Schweden. Which Klarna payment options are offered depends on your country and is shown during the ordering process. Klarna’s terms, which are displayed to you when you select it, apply; depending on the option, Klarna may carry out an identity and credit check.
(5) For prepayment by bank transfer, you will receive our bank details after placing the order. With PayPal.Me, you send the amount to us yourself after placing the order. In each case, please state your order number as the payment reference. We ship once payment has been received.
(6) Unless otherwise stated, the purchase price is due immediately upon conclusion of the contract.
§ 6 Delivery
(1) Delivery areas, delivery times and shipping methods can be found on the Payment and Shipping page and in the respective product offer. For goods with an engraving, the delivery time may be longer; the respective delivery time is stated in the product offer.
(2) If you are a consumer, the risk of accidental loss and accidental deterioration of the goods only passes to you upon handover to you, regardless of whether the shipment is insured. This does not apply if you yourself have commissioned a carrier not named by us.
§ 7 Retention of title and right of retention
(1) The goods remain our property until paid for in full.
(2) You may only exercise a right of retention on the basis of claims arising from the same contractual relationship.
§ 8 Right of withdrawal
Consumers have a right of withdrawal. We voluntarily grant a withdrawal period of 30 days (statutory: 14 days). Details, the model withdrawal form and the exceptions can be found in our Withdrawal Policy. You can withdraw online at any time at Withdraw from contract.
§ 9 Statutory warranty
(1) The statutory rights in respect of defects apply.
(2) If the goods are defective, you as a consumer may choose whether the defect is to be remedied by repair or by delivery of goods free from defects. If you choose repair, the limitation period for your claims for defects is extended once by twelve months (applies to contracts concluded on or after 31 July 2026).
(3) Please check the goods upon receipt for completeness, obvious defects and transport damage and notify us of any complaints as soon as possible. Your statutory rights remain unaffected, even if you do not do so.
(4) Handmade items, enamel and niello may by their nature show slight deviations in colour and texture from the product images. Deviations from the objective requirements are only deemed agreed if we have specifically informed you of them before conclusion of the contract and this has been expressly agreed.
§ 10 Applicable law
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive you of the protection afforded by mandatory provisions of the law of the state in which you have your habitual residence.
(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
